### sec.45 Protection from liability
A person employed by the operator is not civilly liable for an act done or omission made honestly and without negligence in performing a function of the operator mentioned in section 8 (1) (a) , (b) or (c) .
An administrator appointed under section 34 is not civilly liable for an act done or omission made honestly and without negligence in performing a function of the administrator under part 6 , division 4 .
If subsection (1) or (2) prevents civil liability attaching to a person, the liability attaches instead to the State.
Despite the Public Sector Act 2022 , section 267 , an employee of the operator or an administrator appointed under section 34 is not a prescribed person under section 267 of that Act.
