### sec.128 Making codes
The Minister may make codes for this Act for declared services.
Before making a code, the Minister—
must publish the proposed code and invite persons to make submissions on it to the Minister within the reasonable time stated by the Minister; and
must ask the authority to give the Minister information and advice about the code or its contents the authority considers appropriate; and
may ask the authority to give the Minister information and advice about a stated matter relating to the code or its contents.
In making a code, the Minister must have regard to—
any submissions about the proposed code received by the Minister within the time stated by the Minister for subsection (2) (a) ; and
any information or advice given to the Minister by the authority.
The Minister may make a code only if the Minister considers it appropriate to do so having regard to—
the matters mentioned in section 138 (2) (a) to (g) ; and
any other matters the Minister considers relevant.
