### sec.115 Withdrawal of access dispute notice An access dispute notice may be withdrawn only under this section. An access provider or access seeker may withdraw an access dispute notice— if the dispute is to be dealt with by mediation—at any time before a mediated resolution of the dispute is achieved; or if the dispute is to be dealt with by arbitration—at any time before the authority makes its determination. However, the access provider may withdraw the access dispute notice only with the written agreement of the access seeker. Subsection (2) applies whether the access dispute notice was given by the access provider or access seeker. If an access dispute notice is withdrawn, the notice is taken, for this part, never to have been given. s 115 amd 2000 No. 15 s 28 (sec.115-ssec.1) An access dispute notice may be withdrawn only under this section.
