### sec.15 Proceeding in business name if unregistered
This rule applies if—
a proceeding is brought against a person in relation to a business carried on by the person under a name other than the person’s own name; and
the name is not registered on the Business Names Register.
The proceeding may be started against the person in the name under which the person carries on business.
The name under which the business is carried on is sufficient designation of the person in a document filed in the proceeding.
An order in the proceeding may be enforced against the person.

(sec.15-ssec.1) This rule applies if— a proceeding is brought against a person in relation to a business carried on by the person under a name other than the person’s own name; and the name is not registered on the Business Names Register.
(sec.15-ssec.2) The proceeding may be started against the person in the name under which the person carries on business.
(sec.15-ssec.3) The name under which the business is carried on is sufficient designation of the person in a document filed in the proceeding.
(sec.15-ssec.4) An order in the proceeding may be enforced against the person. See, however, rule 16 (4) .
- (a) a proceeding is brought against a person in relation to a business carried on by the person under a name other than the person’s own name; and
- (b) the name is not registered on the Business Names Register.
