### sec.67B Meaning of construction management trade contract
A building contract is a construction management trade contract if—
the contracting party for the building contract is a principal; and
the contracted party for the building contract is the holder of a contractor’s licence; and
the building work the subject of the building contract is part of a wider project of building work (the project ) involving the principal in entering into 1 or more other building contracts, also as a principal, for the carrying out of other building work that is also part of the project; and
the contracted party is not the construction manager for the project.
For deciding whether a principal has entered into a building contract, it does not matter if the building contract was entered into on behalf of the principal, including by a construction manager.

(sec.67B-ssec.1) A building contract is a construction management trade contract if— the contracting party for the building contract is a principal; and the contracted party for the building contract is the holder of a contractor’s licence; and the building work the subject of the building contract is part of a wider project of building work (the project ) involving the principal in entering into 1 or more other building contracts, also as a principal, for the carrying out of other building work that is also part of the project; and the contracted party is not the construction manager for the project.
(sec.67B-ssec.2) For deciding whether a principal has entered into a building contract, it does not matter if the building contract was entered into on behalf of the principal, including by a construction manager.
- (a) the contracting party for the building contract is a principal; and
- (b) the contracted party for the building contract is the holder of a contractor’s licence; and
- (c) the building work the subject of the building contract is part of a wider project of building work (the project ) involving the principal in entering into 1 or more other building contracts, also as a principal, for the carrying out of other building work that is also part of the project; and
- (d) the contracted party is not the construction manager for the project.
