### sec.58 Registration of public thoroughfare easements This section applies to an instrument of easement— in relation to Queen’s Wharf freehold land; and for a right of way for the public; and in favour of the State. The Land Title Act , section 89 (4) , (5) and (6) does not apply to the registration of the easement under that Act. An easement that, apart from subsection (2) , would not be registered under the Land Title Act is taken to be a public thoroughfare easement for that Act. (sec.58-ssec.1) This section applies to an instrument of easement— in relation to Queen’s Wharf freehold land; and for a right of way for the public; and in favour of the State. (sec.58-ssec.2) The Land Title Act , section 89 (4) , (5) and (6) does not apply to the registration of the easement under that Act. (sec.58-ssec.3) An easement that, apart from subsection (2) , would not be registered under the Land Title Act is taken to be a public thoroughfare easement for that Act. - (a) in relation to Queen’s Wharf freehold land; and - (b) for a right of way for the public; and - (c) in favour of the State.
