### sec.38 Issue of enforcement order
This section applies if—
the registrar registers a default certificate for a person; or
this Act expressly authorises the registrar to issue an enforcement order against a person.
The registrar must, in writing, order the person ( enforcement debtor ) to pay the amount stated in the order ( enforcement order ) to SPER within 28 days after the date of the order.
The amount stated in an enforcement order must be—
the amount that is registered as the unpaid amount for an offence; or
the amount for which the registrar is expressly authorised to issue the order.
The enforcement order may be made in the absence of, and without notice to, the enforcement debtor.
The enforcement order must be made in the approved form.
To remove any doubt, it is declared that a single enforcement order may relate to 1 or more infringement notice defaults.
