### sec.12 Protection from liability
An official does not incur civil liability for an act done, or omission made, honestly and without negligence, when acting as an official.
If subsection (1) prevents a civil liability attaching to an official, liability attaches instead to the State.
In this section—
official means—
the registrar; or
another member of the staff of SPER; or
an enforcement officer.
(sec.12-ssec.1) An official does not incur civil liability for an act done, or omission made, honestly and without negligence, when acting as an official.
(sec.12-ssec.2) If subsection (1) prevents a civil liability attaching to an official, liability attaches instead to the State.
(sec.12-ssec.3) In this section— official means— the registrar; or another member of the staff of SPER; or an enforcement officer.
- (a) the registrar; or
- (b) another member of the staff of SPER; or
- (c) an enforcement officer.
