### sec.238 Appointment of commissioner
The commissioner is to be appointed by the Governor in Council.
Subject to sections 242 and 243 , the commissioner holds office for such term (not longer than 7 years) as is specified in the instrument of appointment.
The commissioner is to be appointed under this Act, and not under the Public Sector Act 2022 .

(sec.238-ssec.1) The commissioner is to be appointed by the Governor in Council.
