### sec.204 Burden of proof—general
In a complaint proceeding, if there are facts from which it could be decided, in the absence of any other explanation, that the respondent contravened the provision of the Act the subject of the alleged contravention, the respondent is taken to have contravened the provision.
Subsection (1) does not apply if the respondent proves, on the balance of probabilities, that the respondent did not contravene the provision.
Subsection (1) and (2) apply in addition to any other provision of the Act that provides for who has the onus of proving a particular matter.
