### sec.12 Sale of property by auction by authorised persons
Where the public trustee wishes to sell by auction land or goods in an estate under administration and such land or goods is or are situated at a distance of more than 20km from the usual place of business of a holder of a relevant auctioneer’s licence, such land or goods may be offered for sale by auction at a time and place directed by the public trustee by a person authorised in writing by the public trustee and such person for the purpose of such auction shall not be required to take out an auctioneer’s licence.
In this section—
auctioneer’s licence means—
an auctioneer licence under the Property Occupations Act 2014 ; or
a chattel auctioneer licence under the Motor Dealers and Chattel Auctioneers Act 2014 .
relevant auctioneer’s licence means an auctioneer’s licence under which the sale by auction of the land or goods would be authorised.
