### sec.73 Public sector employee must disclose to chief executive charge or conviction for indictable offence
This section applies if a public sector employee is—
charged with an indictable offence; or
convicted by a court of an indictable offence.
The employee must give the employee’s chief executive a notice stating—
if the employee has been charged with an indictable offence—
that the employee has been charged; and
the details of the alleged offence; or
if the employee has been convicted of an indictable offence—
that the employee has been convicted; and
the details of the offence; and
the penalty imposed on the employee.
The notice must be given—
if the employee has been charged with an indictable offence—immediately after the employee is charged; or
if the employee has been convicted of an indictable offence—immediately after the employee is convicted.
In this section—
convicted includes a finding of guilt, whether or not a conviction is recorded.
indictable offence includes an indictable offence dealt with summarily.
(sec.73-ssec.1) This section applies if a public sector employee is— charged with an indictable offence; or convicted by a court of an indictable offence.
(sec.73-ssec.2) The employee must give the employee’s chief executive a notice stating— if the employee has been charged with an indictable offence— that the employee has been charged; and the details of the alleged offence; or if the employee has been convicted of an indictable offence— that the employee has been convicted; and the details of the offence; and the penalty imposed on the employee.
(sec.73-ssec.3) The notice must be given— if the employee has been charged with an indictable offence—immediately after the employee is charged; or if the employee has been convicted of an indictable offence—immediately after the employee is convicted.
(sec.73-ssec.4) In this section— convicted includes a finding of guilt, whether or not a conviction is recorded. indictable offence includes an indictable offence dealt with summarily.
- (a) charged with an indictable offence; or
- (b) convicted by a court of an indictable offence.
- (a) if the employee has been charged with an indictable offence— (i) that the employee has been charged; and (ii) the details of the alleged offence; or
- (i) that the employee has been charged; and
- (ii) the details of the alleged offence; or
- (b) if the employee has been convicted of an indictable offence— (i) that the employee has been convicted; and (ii) the details of the offence; and (iii) the penalty imposed on the employee.
- (i) that the employee has been convicted; and
- (ii) the details of the offence; and
- (iii) the penalty imposed on the employee.
- (i) that the employee has been charged; and
- (ii) the details of the alleged offence; or
- (i) that the employee has been convicted; and

- (a) if the employee has been charged with an indictable offence—immediately after the employee is charged; or
- (b) if the employee has been convicted of an indictable offence—immediately after the employee is convicted.
