### sec.52 Chief executive may decide to obtain criminal history
This section applies if the chief executive of a public sector entity engages, or proposes to engage, a person to perform a relevant duty in the entity.
Also, this section applies if the chief executive of a public sector entity changes, or proposes to change, the duties of a public sector employee employed in the entity to include a relevant duty.
The chief executive may, under the suitability directive, ask the person for written consent for the chief executive to obtain the person’s criminal history.
(sec.52-ssec.1) This section applies if the chief executive of a public sector entity engages, or proposes to engage, a person to perform a relevant duty in the entity.
(sec.52-ssec.2) Also, this section applies if the chief executive of a public sector entity changes, or proposes to change, the duties of a public sector employee employed in the entity to include a relevant duty.
(sec.52-ssec.3) The chief executive may, under the suitability directive, ask the person for written consent for the chief executive to obtain the person’s criminal history.
