### sec.278 Duty of confidentiality
This section applies to a person who—
is, or has been, any of the following persons performing functions under or relating to the administration of this Act—
a public sector employee;
a staff member of the commission;
a person to whom a function of the commission under section 123 or 124 is delegated by the commissioner;
a reviewing entity;
a selection panel member; and
in that capacity, acquired confidential information or has access to, or custody of, confidential information.
The person must not use or disclose the confidential information to anyone else, other than under this part.
Maximum penalty—100 penalty units.
In this section—
selection panel member means a member of a panel formed to make a recommendation to the chief executive of a public sector entity about employing a person under chapter 3 , part 3 in the entity.

- (i) a public sector employee;
- (ii) a staff member of the commission;
- (iii) a person to whom a function of the commission under section 123 or 124 is delegated by the commissioner;
- (iv) a reviewing entity;
- (v) a selection panel member; and
- (b) in that capacity, acquired confidential information or has access to, or custody of, confidential information.
- (i) a public sector employee;
- (ii) a staff member of the commission;
- (iii) a person to whom a function of the commission under section 123 or 124 is delegated by the commissioner;
- (iv) a reviewing entity;
- (v) a selection panel member; and
