### sec.265 Criminal history checks to confirm suitability for appointment To help decide whether a person is suitable to be recommended for appointment as the commissioner, a special commissioner or a community representative, the Minister may ask the police commissioner for a report about the person’s criminal history. However, the Minister may make the request only if the person has given the Minister written consent for the request. The police commissioner must comply with the request. However, subsection (3) applies only to information in the police commissioner’s possession or to which the police commissioner has access. If the criminal history of the person includes a conviction recorded against the person, the police commissioner’s report must be in writing. The Minister must destroy the report as soon as practicable after the decision has been made.
