### sec.178 Extent of chief executive’s autonomy
A chief executive of a department is subject to the directions of the chief executive’s Minister in managing the department, other than to the extent—
the chief executive is making decisions about particular individuals; or
another Act—
provides that the chief executive is not subject to the directions of the chief executive’s Minister about particular matters; or
limits the extent to which, or circumstances in which, the chief executive is subject to the directions of the chief executive’s Minister.
In making decisions about particular individuals, the chief executive—
is subject to any direction given by the commission in a report about a procedural aspect of a current work performance matter under section 124 ; and
must otherwise act independently, impartially and fairly; and
is not subject to direction by a Minister.

- (a) the chief executive is making decisions about particular individuals; or
- (b) another Act— (i) provides that the chief executive is not subject to the directions of the chief executive’s Minister about particular matters; or (ii) limits the extent to which, or circumstances in which, the chief executive is subject to the directions of the chief executive’s Minister.
- (i) provides that the chief executive is not subject to the directions of the chief executive’s Minister about particular matters; or
- (ii) limits the extent to which, or circumstances in which, the chief executive is subject to the directions of the chief executive’s Minister.
- (i) provides that the chief executive is not subject to the directions of the chief executive’s Minister about particular matters; or
- (ii) limits the extent to which, or circumstances in which, the chief executive is subject to the directions of the chief executive’s Minister.
