### sec.172 Acting chief executive
The Minister administering a department may appoint a person to act as the department’s chief executive during any period or all periods when—
no-one is employed as chief executive; or
the chief executive is absent from duty or is, for another reason, unable to discharge the responsibilities of chief executive.
It does not matter whether the appointee is or is not already a public service officer.
(sec.172-ssec.1) The Minister administering a department may appoint a person to act as the department’s chief executive during any period or all periods when— no-one is employed as chief executive; or the chief executive is absent from duty or is, for another reason, unable to discharge the responsibilities of chief executive.
