### sec.119 Application of division
This division applies to a public sector employee who is acting at, or seconded to, a higher classification level in the public sector entity in which the employee is employed.
However, this division does not apply to—
a public sector employee employed on a casual basis; or
For a public service employee, see sections 149 (2) (c) and 151 .
a non-industrial instrument employee; or
an employee who is acting in, or seconded to, a position that is ordinarily held by a non-industrial instrument employee.
(sec.119-ssec.1) This division applies to a public sector employee who is acting at, or seconded to, a higher classification level in the public sector entity in which the employee is employed.
(sec.119-ssec.2) However, this division does not apply to— a public sector employee employed on a casual basis; or For a public service employee, see sections 149 (2) (c) and 151 . a non-industrial instrument employee; or an employee who is acting in, or seconded to, a position that is ordinarily held by a non-industrial instrument employee.
