### sec.103 Application of division This division applies to a public sector employee if— the employee is absent from duty or the employee’s chief executive is reasonably satisfied the employee is not performing the employee’s duties satisfactorily; and the chief executive reasonably suspects that the employee’s absence or unsatisfactory performance is caused by mental or physical illness or disability. - (a) the employee is absent from duty or the employee’s chief executive is reasonably satisfied the employee is not performing the employee’s duties satisfactorily; and - (b) the chief executive reasonably suspects that the employee’s absence or unsatisfactory performance is caused by mental or physical illness or disability.
