### sec.49 Application for transfer of licence A licensee may apply to the local government that issued a licence for the transfer of the licence. The application must comply with section 58 . The local government must consider the application and either grant or refuse to grant the application. The local government may grant the application only if the local government is satisfied— the proposed transferee is a suitable person to hold a licence; and the premises at which the higher risk personal appearance services are to be provided are suitable for providing the services. In deciding whether to grant the application, the local government may, in relation to the proposed transferee, have regard to the matters to which the local government may have regard in deciding whether a person is a suitable person to hold a licence and whether the premises are suitable for providing higher risk personal appearance services. See section 35 in relation to the matters a local government may have regard to in deciding whether a person is a suitable person to hold a licence. See section 36 in relation to the matters a local government may have regard to in deciding whether premises at which higher risk personal appearance services are to be provided are suitable for providing the services. If the local government decides to refuse to transfer the licence, the local government must immediately give the licensee an information notice for the decision. If the local government decides to impose conditions on the transferred licence, the local government must immediately give the transferee an information notice for the decision. A licence may be transferred by— endorsing the existing licence with details of the transfer; or cancelling the existing licence and issuing another licence to the transferee. s 49 amd 2022 No. 1 s 117 s ch 1 pt 2 (sec.49-ssec.1) A licensee may apply to the local government that issued a licence for the transfer of the licence.
