### sec.161 Continuing application of former pt 4, div 2
This section applies if—
before the commencement, a person made an application under former section 44; and
immediately before the commencement, the application—
had not been decided under former section 44; and
was not taken to have been withdrawn under section 45(2); and
had not been otherwise withdrawn.
Former part 4, division 2 continues to apply in relation to the application as if the Health and Other Legislation Amendment Act 2022 had not commenced.
In this section—
former , for a provision of this Act, means the provision as in force from time to time before the commencement.

(sec.161-ssec.1) This section applies if— before the commencement, a person made an application under former section 44; and immediately before the commencement, the application— had not been decided under former section 44; and was not taken to have been withdrawn under section 45(2); and had not been otherwise withdrawn.
(sec.161-ssec.2) Former part 4, division 2 continues to apply in relation to the application as if the Health and Other Legislation Amendment Act 2022 had not commenced.
(sec.161-ssec.3) In this section— former , for a provision of this Act, means the provision as in force from time to time before the commencement.
- (a) before the commencement, a person made an application under former section 44; and
- (b) immediately before the commencement, the application— (i) had not been decided under former section 44; and (ii) was not taken to have been withdrawn under section 45(2); and (iii) had not been otherwise withdrawn.
