### sec.55 Confidentiality of information
A relevant person must not, whether directly or indirectly, disclose confidential information.
Maximum penalty—50 penalty units.
However, subsection (1) does not apply if—
the confidential information is disclosed—
in the performance of functions under this Act; or
with the written consent of the person to whom the information relates; or
to the person to whom the information relates; or
in a form that could not identify any person; or
the disclosure of the confidential information is authorised under an Act or another law.
The Hospital and Health Boards Act 2011 , section 142 does not apply to a relevant person in relation to confidential information.
As a specific offence is created under subsection (1) , subsection (3) provides that the more general provision in the Hospital and Health Boards Act 2011 , section 142 (Confidential information must not be disclosed) does not apply.

- (b) the disclosure of the confidential information is authorised under an Act or another law.
