### sec.327 Declaration of emergency notifiable condition as controlled notifiable condition
This section applies if the Minister is satisfied—
an emergency notifiable condition exists; and
it is appropriate, having regard to the nature of the declared public health emergency, to declare the emergency notifiable condition to be a controlled notifiable condition.
The Minister may declare the emergency notifiable condition to be a controlled notifiable condition by a signed written declaration (a controlled notifiable conditions declaration ).
However, before declaring an emergency notifiable condition to be a controlled notifiable condition the Minister must, if practicable, consult the chief executive and the chief health officer.
If it has not been practicable to consult with the chief executive or the chief health officer under subsection (3) , the Minister must consult as soon as practicable after the declaration.
To remove any doubt, it is declared that an emergency notifiable condition declared to be a controlled notifiable condition under subsection (2) is a controlled notifiable condition for chapter 3 .

(sec.327-ssec.5) To remove any doubt, it is declared that an emergency notifiable condition declared to be a controlled notifiable condition under subsection (2) is a controlled notifiable condition for chapter 3 .
- (a) an emergency notifiable condition exists; and
- (b) it is appropriate, having regard to the nature of the declared public health emergency, to declare the emergency notifiable condition to be a controlled notifiable condition.
