### sec.319 Declaration of public health emergency
This section applies if the Minister is satisfied—
there is a public health emergency; and
it is necessary to exercise powers under this chapter to prevent or minimise serious adverse effects on human health.
The Minister may declare a public health emergency by a signed written order (a public health emergency order ).
However, before declaring a public health emergency the Minister must, if practicable, consult with the chief executive and the chief health officer.
If it has not been practicable to consult with the chief executive or the chief health officer under subsection (3) , the Minister must consult as soon as practicable after the declaration of the public health emergency.
A public health emergency order takes effect from its declaration by the Minister by signed written order.
