### sec.187 Person in charge of facility has custody of child held at facility
This section applies if a child—
is held at a health service facility under this part; or
is being transferred from one health service facility to another under this part.
The person in charge of the health service facility at which the child is held has custody of the child and has—
the right to have the child’s daily care; and
the right and responsibility to make decisions about the child’s daily care.
Subsection (4) applies to a child being transferred from one health service facility (the first facility ) to another health service facility (the second facility ) under this part.
The child is taken to be held at the first facility until the child is accepted by the second facility after which the child is taken to be held at the second facility.
(sec.187-ssec.1) This section applies if a child— is held at a health service facility under this part; or is being transferred from one health service facility to another under this part.
(sec.187-ssec.2) The person in charge of the health service facility at which the child is held has custody of the child and has— the right to have the child’s daily care; and the right and responsibility to make decisions about the child’s daily care.
(sec.187-ssec.3) Subsection (4) applies to a child being transferred from one health service facility (the first facility ) to another health service facility (the second facility ) under this part.
(sec.187-ssec.4) The child is taken to be held at the first facility until the child is accepted by the second facility after which the child is taken to be held at the second facility.
- (a) is held at a health service facility under this part; or
- (b) is being transferred from one health service facility to another under this part.
- (a) the right to have the child’s daily care; and
- (b) the right and responsibility to make decisions about the child’s daily care.
