### sec.159 Who is a parent
For part 2 , a parent of a child is—
the child’s mother, father or someone else having or exercising parental responsibility for the child; or
for a child who is in the custody or guardianship of the chief executive (child safety) under the Child Protection Act 1999 , the chief executive (child safety).
For part 3 , a parent of a child is the child’s mother, father or someone else, other than the chief executive (child safety), having or exercising parental responsibility for the child.
In this chapter generally, the following apply—
a parent of an Aboriginal child includes a person who, under Aboriginal tradition, is regarded as a parent of the child;
a parent of a Torres Strait Islander child includes a person who, under Island custom, is regarded as a parent of the child;
a reference in this part to the parents of a child or to 1 of the parents of a child is, if the child has only 1 parent, a reference to the parent.
