What it does
The Public and Bank Holidays Act 1972 (WA) (the Act) performs a deceptively straightforward yet practically significant function: it statutorily designates a closed list of days as public holidays and bank holidays throughout Western Australia. Section 5 provides that, subject to the Act, the days specified or appointed under the Second Schedule “shall be public holidays and bank holidays throughout the State”. The Second Schedule enumerates twelve core days: New Year’s Day (1 January), Australia Day (26 January or the following Monday if it falls on a weekend), Labour Day (first Monday in March or the following Monday), Good Friday, Easter Sunday, Easter Monday, Anzac Day (25 April), Western Australia Day (first Monday in June or the following Monday), the King’s Birthday (appointed annually by proclamation), Christmas Day (25 December) and Boxing Day (26 December).
The Act then overlays a series of mechanical rules that adjust these dates when they fall on weekends. When New Year’s Day, Anzac Day or Christmas Day falls on a Saturday or Sunday, “the next following Monday is also a public holiday and bank holiday”. When Boxing Day falls on a Saturday the next Monday is added; when it falls on a Sunday or Monday the next Tuesday is added. These rules are not discretionary; they operate automatically by force of the Schedule.
Layered atop the fixed calendar are two distinct executive powers. Under s 7(1) the Governor may proclaim a special public holiday, bank holiday, or public half-holiday for the whole State or any district. A subsequent proclamation may vary or cancel the earlier one provided it is published in the Government Gazette at least three weeks before the relevant day (s 7(2)). Section 8 confers a parallel power to substitute an alternative day for any day referred to in s 5, again by proclamation published at least three weeks in advance, with a similar variation power. These mechanisms allow the executive to respond to extraordinary events—bushfires, royal visits, or national mourning—without amending the statute.
