### sec.268 Statutory warranty for used motor vehicles sold by pre-commencement auctioneers
This section applies if—
before the commencement, a pre-commencement auctioneer sold a warranted vehicle as mentioned in PAMDA, section 237(1) and not as mentioned in PAMDA, section 237(2); and
on the commencement, the warranty period under PAMDA, section 236 for the vehicle had not ended.
The relevant warranty provisions continue to apply in relation to the warranted vehicle as if PAMDA had not been repealed.
In this section—
pre-commencement auctioneer means an auctioneer under PAMDA, schedule 2.
relevant warranty provisions means—
PAMDA, sections 242 to 249; and
any other provisions of PAMDA relevant to the interpretation of the provisions mentioned in paragraph (a).
warranted vehicle means a class A warranted vehicle, or a class B warranted vehicle, under PAMDA, schedule 2.
(sec.268-ssec.1) This section applies if— before the commencement, a pre-commencement auctioneer sold a warranted vehicle as mentioned in PAMDA, section 237(1) and not as mentioned in PAMDA, section 237(2); and on the commencement, the warranty period under PAMDA, section 236 for the vehicle had not ended.
(sec.268-ssec.2) The relevant warranty provisions continue to apply in relation to the warranted vehicle as if PAMDA had not been repealed.
(sec.268-ssec.3) In this section— pre-commencement auctioneer means an auctioneer under PAMDA, schedule 2. relevant warranty provisions means— PAMDA, sections 242 to 249; and any other provisions of PAMDA relevant to the interpretation of the provisions mentioned in paragraph (a). warranted vehicle means a class A warranted vehicle, or a class B warranted vehicle, under PAMDA, schedule 2.
