### sec.94 Buyer not in default may require seller to transfer land
A buyer not in default under an instalment contract may give a notice to the seller requiring the seller to transfer the land on a stated day (the day of settlement ) in exchange for payment of the balance of the purchase money owing at the day of settlement.
The notice must—
make time of the essence of the contract, if time is not already of the essence of the contract; and
be given to the seller at least 3 months before the day of settlement.
(sec.94-ssec.1) A buyer not in default under an instalment contract may give a notice to the seller requiring the seller to transfer the land on a stated day (the day of settlement ) in exchange for payment of the balance of the purchase money owing at the day of settlement.
(sec.94-ssec.2) The notice must— make time of the essence of the contract, if time is not already of the essence of the contract; and be given to the seller at least 3 months before the day of settlement.
