### sec.72 Effect of statutory requirement for certificate
This section applies if an Act requires a certificate to be obtained or given before or when—
entering a contract for the disposition of property; or
making a disposition of property.
It is sufficient compliance with the requirement if the certificate is obtained or given before settlement of the contract or disposition.
Subsection (2) does not apply if this Act or another Act expressly provides otherwise.
In this section—
certificate includes an approval and a consent.
settlement , of a contract or disposition, means—
for a sale—settlement of the sale; or
for a lease—entry into possession under the lease by the lessee; or
for a mortgage—the acceptance of liability under the mortgage by the mortgagor; or
otherwise—the finalisation of the contract or disposition.
(sec.72-ssec.1) This section applies if an Act requires a certificate to be obtained or given before or when— entering a contract for the disposition of property; or making a disposition of property.
(sec.72-ssec.2) It is sufficient compliance with the requirement if the certificate is obtained or given before settlement of the contract or disposition.
(sec.72-ssec.3) Subsection (2) does not apply if this Act or another Act expressly provides otherwise.

- (a) entering a contract for the disposition of property; or
- (b) making a disposition of property.
- (a) for a sale—settlement of the sale; or
- (b) for a lease—entry into possession under the lease by the lessee; or
- (c) for a mortgage—the acceptance of liability under the mortgage by the mortgagor; or
- (d) otherwise—the finalisation of the contract or disposition.
