### sec.54 Execution by the State
A person who is authorised to execute a document that is to have effect as a deed for the State may execute the document by signing the document.
The person may sign the document under subsection (1) without using a seal and whether or not in the presence of a witness.
If a seal is used to execute a document that is to have effect as a deed for the State, the fixing of the seal to the document is taken to have been witnessed by a person who is authorised to witness the fixing of the seal if—
the person observes the fixing of the seal by audio visual link; and
the person signs the document; and
the document includes a statement that the person observed the fixing of the seal by audio visual link.
This section does not limit or otherwise affect—
section 52 (3) ; or
the State’s powers or legal capacity under another law.
In this section—
State includes a public sector unit and any other entity that represents the State.
(sec.54-ssec.1) A person who is authorised to execute a document that is to have effect as a deed for the State may execute the document by signing the document.
(sec.54-ssec.2) The person may sign the document under subsection (1) without using a seal and whether or not in the presence of a witness.
(sec.54-ssec.3) If a seal is used to execute a document that is to have effect as a deed for the State, the fixing of the seal to the document is taken to have been witnessed by a person who is authorised to witness the fixing of the seal if— the person observes the fixing of the seal by audio visual link; and the person signs the document; and the document includes a statement that the person observed the fixing of the seal by audio visual link.
(sec.54-ssec.4) This section does not limit or otherwise affect— section 52 (3) ; or the State’s powers or legal capacity under another law.
(sec.54-ssec.5) In this section— State includes a public sector unit and any other entity that represents the State.
- (a) the person observes the fixing of the seal by audio visual link; and
- (b) the person signs the document; and
- (c) the document includes a statement that the person observed the fixing of the seal by audio visual link.
