### sec.175 Termination of periodic tenancy
A party to a periodic tenancy may terminate the tenancy, on a stated day that is the last day of a period of the tenancy (the termination day ), by giving a termination notice to the other party—
for a weekly tenancy—at least 1 week before the termination day; or
for a monthly tenancy—at least 1 month before the termination day; or
for a yearly tenancy—at least 6 months before the termination day; or
for a tenancy for a period other than a week, a month or a year—at least the required period for the tenancy before the termination day.
For subsection (1) (d) , subject to any contrary agreement, the period of the tenancy is taken to start on the day on which rent under the tenancy is payable.
In this section—
required period , for a tenancy, means the lesser of the following periods—
the period of the tenancy;
6 months.
(sec.175-ssec.1) A party to a periodic tenancy may terminate the tenancy, on a stated day that is the last day of a period of the tenancy (the termination day ), by giving a termination notice to the other party— for a weekly tenancy—at least 1 week before the termination day; or for a monthly tenancy—at least 1 month before the termination day; or for a yearly tenancy—at least 6 months before the termination day; or for a tenancy for a period other than a week, a month or a year—at least the required period for the tenancy before the termination day.
(sec.175-ssec.2) For subsection (1) (d) , subject to any contrary agreement, the period of the tenancy is taken to start on the day on which rent under the tenancy is payable.
(sec.175-ssec.3) In this section— required period , for a tenancy, means the lesser of the following periods— the period of the tenancy; 6 months.
- (a) for a weekly tenancy—at least 1 week before the termination day; or
- (b) for a monthly tenancy—at least 1 month before the termination day; or
- (c) for a yearly tenancy—at least 6 months before the termination day; or
- (d) for a tenancy for a period other than a week, a month or a year—at least the required period for the tenancy before the termination day.
