### sec.168 Apportionment in respect of time
This section applies to a payment of rent under a lease in relation to a fixed or ascertainable period, whether or not the payment is reserved or made payable under a document.
The payment—
is to be regarded as accruing from day to day; and
is apportionable in respect of time in relation to both the liability to make, and the right to receive, the payment.
This section is subject to any agreement to the contrary.
(sec.168-ssec.1) This section applies to a payment of rent under a lease in relation to a fixed or ascertainable period, whether or not the payment is reserved or made payable under a document.
(sec.168-ssec.2) The payment— is to be regarded as accruing from day to day; and is apportionable in respect of time in relation to both the liability to make, and the right to receive, the payment.
(sec.168-ssec.3) This section is subject to any agreement to the contrary.
