### sec.138 Lease for term of years may take effect without entry into possession A lease of land for a term of years is capable of taking effect at law or in equity from the start of the term, without entry into possession of the land. This section— does not affect the right of a person to recover rent or to take advantage of a term of the lease; and does not limit or otherwise affect section 10 (2) . In this section— term of years includes a term for less than a year, or for 1 or more years or from year to year. (sec.138-ssec.1) A lease of land for a term of years is capable of taking effect at law or in equity from the start of the term, without entry into possession of the land. (sec.138-ssec.2) This section— does not affect the right of a person to recover rent or to take advantage of a term of the lease; and does not limit or otherwise affect section 10 (2) .
