### sec.112J Decision on application
The Minister must consider the application and decide to either grant, or refuse to grant, the application.
When considering the application, the Minister must have regard to the board’s report on the application but is not bound by any recommendation contained in the report.
The Minister may grant the application only if the Minister is satisfied that—
for an application for approval—the proposed assessment scheme is suitable for approval; or
for an application for renewal—the assessment scheme continues to be suitable for approval; or
for an application for variation—the assessment scheme as proposed to be varied is suitable for approval.
The Minister may, in granting the application, decide to impose conditions on the approval that are reasonable and relevant.
