### sec.804 Compensation
This section applies if a person suffers loss because—
a police officer exercises powers under this Act; or
a protective services officer exercises powers under chapter 19 , part 1 ; or
an assistant exercises powers under this Act in accordance with a request of a police officer or protective services officer given under section 612 .
Compensation is payable by the State to the person whose property is damaged.
However, compensation is not payable to a person if the person is found guilty of the commission of an indictable offence because of the exercise of the powers.
Also, compensation is not payable for the lawful seizure of a thing under this Act.
The Minister is to decide the amount of the compensation.
A person who is dissatisfied with the Minister’s decision under subsection (5) may apply to a court, within 28 days, for compensation under this section.
If the person applies under subsection (6) , the court may decide the amount of the compensation.
The Minister may delegate the Minister’s powers under this section to the commissioner.
