### sec.758 Application for impounding order for evasion offence This section applies if a person who has not previously been found guilty of an evasion offence committed within the relevant period is charged with an evasion offence and an application under section 759 can not be made for a forfeiture order for the motor vehicle involved in the offence. A police officer may apply to the relevant court in the approved form for an order that the motor vehicle involved in the offence be impounded and held at a holding yard for a period of not more than 3 months ( impounding order ). Subsection (2) applies even though the value of the motor vehicle may be more than the maximum amount that may be claimed in a personal action in the civil jurisdiction of a Magistrates Court. s 758 ins 2006 No. 26 s 79 amd 2007 No. 1 s 23 (sec.758-ssec.1) This section applies if a person who has not previously been found guilty of an evasion offence committed within the relevant period is charged with an evasion offence and an application under section 759 can not be made for a forfeiture order for the motor vehicle involved in the offence.
