is for use or has been used in the administration, consumption or smoking of a dangerous drug; and
is no longer required as evidence in a proceeding.
The commissioner may destroy the drug matter in a way that prevents it being used in the commission of an offence.
Drug matter that is a hypodermic syringe or needle and is disposed of in a way required under the Drugs Misuse Regulation 1987 is taken to have been destroyed.
This section applies even though a proceeding for an offence in which the drug matter may be relevant has not been started or, if started, has not been decided.
