### sec.579 How to decide what is excessive noise—noise emitted by motorbike driven on a place that is not a road
This section applies if—
a complaint has been made about noise; and
the complaint relates to noise emitted by a motorbike being driven on a place that is not a road; and
a police officer attending in response to the complaint is reasonably satisfied the noise complained of is clearly audible at or near residential or commercial premises.
In deciding, for this part, whether the noise is excessive in the circumstances, the police officer may have regard to any relevant matters, including—
the degree of interference the noise is causing, or is likely to cause, to the conduct of activities ordinarily carried out in the vicinity of the place from which the noise is being emitted; and
the nature of the lawful uses permitted for premises in the vicinity of the place from which the noise is being emitted.

(sec.579-ssec.1) This section applies if— a complaint has been made about noise; and the complaint relates to noise emitted by a motorbike being driven on a place that is not a road; and a police officer attending in response to the complaint is reasonably satisfied the noise complained of is clearly audible at or near residential or commercial premises.
(sec.579-ssec.2) In deciding, for this part, whether the noise is excessive in the circumstances, the police officer may have regard to any relevant matters, including— the degree of interference the noise is causing, or is likely to cause, to the conduct of activities ordinarily carried out in the vicinity of the place from which the noise is being emitted; and the nature of the lawful uses permitted for premises in the vicinity of the place from which the noise is being emitted.

- (c) a police officer attending in response to the complaint is reasonably satisfied the noise complained of is clearly audible at or near residential or commercial premises.
