### sec.39K Effect of part on power to search person without warrant
To remove any doubt, it is declared that—
the power conferred by this part for a police officer to use a hand held scanner in relation to a person without a warrant does not confer power on a police officer to search a person without a warrant; and
this part does not affect the power of a police officer to search a person without a warrant under part 2 , division 2 .
