### sec.390 Court must strike out notice to appear if service insufficient
If a person fails to appear before a court as required by a notice to appear and the court is not satisfied the person was served as required under this Act, the court must strike out the notice to appear.
The striking out of a notice to appear under subsection (1) does not prevent another proceeding being started for the offence for which the notice to appear was purportedly served.
