### sec.312 Misuse of assumed identity
An authorised officer commits an offence if—
the officer intentionally, knowingly or recklessly acquires evidence of, or uses, an assumed identity covered by the officer’s authority; and
the officer knows that, or is reckless as to whether, the acquisition or use is not—
in accordance with the officer’s authority; or
in the course of duty.
Maximum penalty—2 years imprisonment.
An authorised civilian commits an offence if—
the person intentionally, knowingly or recklessly acquires evidence of, or uses, an assumed identity covered by the person’s authority; and
the person knows that, or is reckless as to whether, the acquisition or use is not in accordance with—
the person’s authority; or
the directions of the person’s supervisor under the authority.
Maximum penalty—2 years imprisonment.
