### sec.297 Categorising development under designations
This section applies if—
either—
a designation of land for community infrastructure under the old Act is in force when the old Act is repealed; or
a designation of land for community infrastructure is made under the old Act after the commencement; and
development under the designation is to be carried out after the commencement.
The development is categorised as follows, instead of the way stated in section 44(6)—
for development that was categorised as assessable development by a planning scheme, or temporary local planning instrument, made under the old Act—accepted development;
to the extent the development involves reconfiguring a lot—accepted development;
otherwise—the category of development stated in a categorising instrument that is a regulation made under section 44.

(sec.297-ssec.1) This section applies if— either— a designation of land for community infrastructure under the old Act is in force when the old Act is repealed; or a designation of land for community infrastructure is made under the old Act after the commencement; and development under the designation is to be carried out after the commencement.
(sec.297-ssec.2) The development is categorised as follows, instead of the way stated in section 44(6)— for development that was categorised as assessable development by a planning scheme, or temporary local planning instrument, made under the old Act—accepted development; to the extent the development involves reconfiguring a lot—accepted development; otherwise—the category of development stated in a categorising instrument that is a regulation made under section 44.
- (a) either— (i) a designation of land for community infrastructure under the old Act is in force when the old Act is repealed; or (ii) a designation of land for community infrastructure is made under the old Act after the commencement; and
- (i) a designation of land for community infrastructure under the old Act is in force when the old Act is repealed; or
- (ii) a designation of land for community infrastructure is made under the old Act after the commencement; and
- (b) development under the designation is to be carried out after the commencement.
- (i) a designation of land for community infrastructure under the old Act is in force when the old Act is repealed; or
- (ii) a designation of land for community infrastructure is made under the old Act after the commencement; and
- (a) for development that was categorised as assessable development by a planning scheme, or temporary local planning instrument, made under the old Act—accepted development;
- (b) to the extent the development involves reconfiguring a lot—accepted development;
- (c) otherwise—the category of development stated in a categorising instrument that is a regulation made under section 44.
