### sec.170 Notifying about show cause and enforcement notices
This section applies if the enforcement authority gives a show cause notice or enforcement notice to a person.
If—
the notice relates to development in relation to which a local government could have been the assessment manager, but was not the assessment manager; and
the enforcement authority is not the local government;
the enforcement authority must give a copy of the notice to the local government.
If—
the notice relates to development in relation to which the chief executive could have been the assessment manager, but was not the assessment manager; and
the enforcement authority is not the chief executive;
the enforcement authority must give a copy of the notice to the chief executive.
If the enforcement authority withdraws the show cause notice or enforcement notice, the enforcement authority must give notice of the withdrawal to—
for a notice given under subsection (2) —the local government; or
for a notice given under subsection (3) —the chief executive.
A failure to comply with subsection (2) or (3) does not invalidate or otherwise affect the show cause notice or enforcement notice.
(sec.170-ssec.1) This section applies if the enforcement authority gives a show cause notice or enforcement notice to a person.
(sec.170-ssec.2) If— the notice relates to development in relation to which a local government could have been the assessment manager, but was not the assessment manager; and the enforcement authority is not the local government; the enforcement authority must give a copy of the notice to the local government.
(sec.170-ssec.3) If— the notice relates to development in relation to which the chief executive could have been the assessment manager, but was not the assessment manager; and the enforcement authority is not the chief executive; the enforcement authority must give a copy of the notice to the chief executive.
(sec.170-ssec.4) If the enforcement authority withdraws the show cause notice or enforcement notice, the enforcement authority must give notice of the withdrawal to— for a notice given under subsection (2) —the local government; or for a notice given under subsection (3) —the chief executive.
(sec.170-ssec.5) A failure to comply with subsection (2) or (3) does not invalidate or otherwise affect the show cause notice or enforcement notice.
