### sec.159 Particular local government land held on trust
Land given to, or taken by, a local government for public parks infrastructure or local community facilities under this chapter must be given or taken in fee simple on trust.
If the local government later sells the land—
the land is sold free of the trust; and
the net proceeds of the sale must be used to provide trunk infrastructure.
(sec.159-ssec.1) Land given to, or taken by, a local government for public parks infrastructure or local community facilities under this chapter must be given or taken in fee simple on trust.
(sec.159-ssec.2) If the local government later sells the land— the land is sold free of the trust; and the net proceeds of the sale must be used to provide trunk infrastructure.
- (a) the land is sold free of the trust; and
- (b) the net proceeds of the sale must be used to provide trunk infrastructure.
