### sec.106ZF Directions given by chief executive
This section applies if—
the chief executive gives the applicant for a development application or change application a notice under section 106ZE (1) ; and
the chief executive is not the assessment manager for the development application or the responsible entity for the change application.
The notice may direct the assessment manager for the development application or the responsible entity for the change application to impose a stated community benefit condition on any development approval given for the application.
If the notice includes a direction under subsection (2) —
the notice must state the reasons for giving the direction; and
the chief executive must give a copy of the notice to the assessment manager for the development application or the responsible entity for the change application; and
the assessment manager or responsible entity must comply with the direction.
Subsection (5) applies if—
the chief executive gives a direction under subsection (2) in relation to the development application or change application (the earlier direction ); and
after the direction is given, the applicant changes the development application or change application.
If the chief executive gives a direction under subsection (2) in relation to the development application, or change application, as changed, the earlier direction stops having effect.
In this section—
community benefit condition means a condition mentioned in section 65AA (2) (b) or (c) or (3) .

(sec.106ZF-ssec.1) This section applies if— the chief executive gives the applicant for a development application or change application a notice under section 106ZE (1) ; and the chief executive is not the assessment manager for the development application or the responsible entity for the change application.
(sec.106ZF-ssec.2) The notice may direct the assessment manager for the development application or the responsible entity for the change application to impose a stated community benefit condition on any development approval given for the application.
(sec.106ZF-ssec.3) If the notice includes a direction under subsection (2) — the notice must state the reasons for giving the direction; and the chief executive must give a copy of the notice to the assessment manager for the development application or the responsible entity for the change application; and the assessment manager or responsible entity must comply with the direction.
(sec.106ZF-ssec.4) Subsection (5) applies if— the chief executive gives a direction under subsection (2) in relation to the development application or change application (the earlier direction ); and after the direction is given, the applicant changes the development application or change application.
(sec.106ZF-ssec.5) If the chief executive gives a direction under subsection (2) in relation to the development application, or change application, as changed, the earlier direction stops having effect.
(sec.106ZF-ssec.6) In this section— community benefit condition means a condition mentioned in section 65AA (2) (b) or (c) or (3) .
- (a) the chief executive gives the applicant for a development application or change application a notice under section 106ZE (1) ; and
- (b) the chief executive is not the assessment manager for the development application or the responsible entity for the change application.
- (a) the notice must state the reasons for giving the direction; and
- (b) the chief executive must give a copy of the notice to the assessment manager for the development application or the responsible entity for the change application; and
- (c) the assessment manager or responsible entity must comply with the direction.
- (a) the chief executive gives a direction under subsection (2) in relation to the development application or change application (the earlier direction ); and
- (b) after the direction is given, the applicant changes the development application or change application.
