### sec.808 Restriction on changing surface of pipeline land for a pipeline licence A person must not change the surface of pipeline land for a pipeline licence in a way that changes, or may cause a change to, the depth of burial of a pipeline unless— the pipeline licence holder consents; or the change is necessary to preserve life or property because of a dangerous situation or emergency that exists or may exist; or the change is a change to a public road by or for its public road authority and the authority has complied with section 427 in relation to the change; or the person has a reasonable excuse. Maximum penalty—500 penalty units. If a corporation commits an offence against this provision, an executive officer of the corporation may be taken, under section 814A , to have also committed the offence. s 808 amd 2004 No. 26 ss 236 , 69 (2) sch ; 2013 No. 51 s 229 sch 1 - (a) the pipeline licence holder consents; or - (b) the change is necessary to preserve life or property because of a dangerous situation or emergency that exists or may exist; or - (c) the change is a change to a public road by or for its public road authority and the authority has complied with section 427 in relation to the change; or - (d) the person has a reasonable excuse.
