### sec.43 Criteria for decisions
The matters that must be considered in deciding whether to grant an authority to prospect or deciding its provisions include—
any special criteria; and
the extent to which the Minister is of the opinion that the tenderer is capable of carrying out authorised activities for the authority, having regard to the tenderer’s—
financial and technical resources; and
ability to manage petroleum exploration and production; and
the applicant’s proposed initial work program.
The matters mentioned in subsection (1) (b) are the capability criteria .
A person satisfies the capability criteria if the Minister forms the opinion mentioned in subsection (1) (b) .
(sec.43-ssec.1) The matters that must be considered in deciding whether to grant an authority to prospect or deciding its provisions include— any special criteria; and the extent to which the Minister is of the opinion that the tenderer is capable of carrying out authorised activities for the authority, having regard to the tenderer’s— financial and technical resources; and ability to manage petroleum exploration and production; and the applicant’s proposed initial work program.
(sec.43-ssec.2) The matters mentioned in subsection (1) (b) are the capability criteria .
(sec.43-ssec.3) A person satisfies the capability criteria if the Minister forms the opinion mentioned in subsection (1) (b) .
- (a) any special criteria; and
- (b) the extent to which the Minister is of the opinion that the tenderer is capable of carrying out authorised activities for the authority, having regard to the tenderer’s— (i) financial and technical resources; and (ii) ability to manage petroleum exploration and production; and
- (i) financial and technical resources; and
- (ii) ability to manage petroleum exploration and production; and
- (c) the applicant’s proposed initial work program.
