### sec.323 Notice to applicant and coal or oil shale exploration tenement holder
The chief executive must give the applicant and the coal or oil shale exploration tenement holder notice of the preference decision.
The notice must invite the tenement holder to, within 6 months after the giving of the notice (the mining lease application period ), apply for a mining lease for—
if the preference is for all of the land—all of the land; or
if the preference is for part of the land—that part.
(sec.323-ssec.1) The chief executive must give the applicant and the coal or oil shale exploration tenement holder notice of the preference decision.
