### sec.31 Operation of div 1 This division provides for the key authorised activities for an authority to prospect. For other authorised activities, see chapter 2 , part 4 , chapter 5 , part 8 and the Common Provisions Act , chapter 3 , part 2 . The carrying out of particular activities on particular land in an authority to prospect’s area may not be authorised following the taking of the land under a resumption law. See section 30AB . The authorised activities may be carried out despite the rights of an owner or occupier of land on which they are exercised. However, the carrying out of the authorised activities is subject to— section 6 ; and chapter 3 , part 4 , division 2 ; and chapter 3 , part 4A ; and chapter 3A , part 5 ; and chapters 5 and 9; and the mandatory and other conditions of the authority; and any exclusion or restriction provided for in the authority on the carrying out of the activities; and any other relevant Act or law. s 31 amd 2009 No. 3 s 540 ; 2010 No. 31 s 428 ; 2011 No. 2 ss 121 , 122 sch ; 2012 No. 20 s 80 ; 2014 No. 47 s 551 (sec.31-ssec.1) This division provides for the key authorised activities for an authority to prospect.
